These general terms and conditions ("Terms") apply when you as a consumer ("Customer") place an order via www.homeofess.com and associated pages ("Website"). An agreement is entered into between the Customer and Home of ESS AB, reg. no. 559285-3450, ("Home of ESS").

Ordering

After completing a purchase, an order confirmation is sent to your email address, which means that a purchase agreement has been concluded and acceptance of our terms of purchase. In the confirmation, you will find information about products, price, billing, and delivery address. When your order is on its way to you, we will also send a delivery confirmation to you via email. If there is any mistake in the order, please contact us as soon as possible by email or phone. We encourage you to save the order confirmation as a basis for a completed purchase. Home of ESS AB reserves the right to deny customers' purchases. All orders are considered binding, but if you have made a mistake in your order, you must contact us by email or phone as soon as possible. To be able to complete your purchase, you must be 18 years old or older.


We reserve the right to correct any printing errors. We do not guarantee that the images accurately represent the products' exact appearance, as colors may vary depending on photo quality, resolution, and the type of screen used. However, our goal is always to visualize the products as accurately as possible.


We may need to refuse an order if you have provided incorrect information at checkout, if we suspect attempted fraud, or if the order cannot be completed because the product is out of stock.


Prices and Product Information

When ordering, the prices stated on the Website at the time of ordering apply. All prices are presented in local currency and include VAT and payment fees.


If the price of a product or the information about a product stated on the Website is incorrect and you noticed or should have noticed this at the time of your order, the price or information will not apply to the purchase. If this is the case, we will contact you as soon as possible.


The Website and all its content are owned by us or our licensors. The information on the Website is protected by, among other things, intellectual property and marketing legislation. This means that you may not copy or use Home of ESS trademarks, company names, images, graphics, design, layout, product information, services, or other content without our prior written consent.


From time to time, we may offer promotions, discount codes, and other offers for various products ("Offers"). Such Offers apply only for the time specified in connection with such an Offer and as long as the product is in stock. Offers cannot be combined with other discounts unless expressly stated on the Website.


You need to enter any code or otherwise activate the current Offer before completing the purchase to take advantage of the Offer. If you return ordered products, you may no longer meet the conditions for the Offer, which may require you to return any gift or pay for the value of the gift. In such cases, we will contact you.


Payment

We cooperate with Klarna regarding payment. By providing information at checkout, you accept Klarna's terms. By clicking "Complete purchase," you accept our general terms and conditions.

For invoice payment or installment payment, Home of ESS or its partners may conduct a credit check.

If you cancel the item or otherwise withdraw from the agreement, we have the right to charge a compensation fee for the costs of withdrawing from the agreement.


Refund

If you exercise the right of withdrawal or return and the item is found to be in unchanged condition, we will refund the value of the item minus the return shipping cost. The refund will be made within 14 business days from the date we approved the return.


Delivery and Transport

Smaller shipments are sent as packages and can be collected at the chosen pickup point after you have received notification. If you want home delivery, this is possible for selected products at a cost. Notification is sent via SMS and/or email. In your delivery notification, there is a tracking link where you can track the shipment of your package.


Larger shipments are delivered directly to the specified delivery address, to the property line or stairwell door, provided that the truck can access it. If you have chosen in-home delivery, an additional cost will be added. In-home delivery may not always be offered due to the transport provider's limitations. The option of in-home delivery will only be available at checkout for areas where it can be offered. When you receive your delivery, we ask you to check it against the shipping document that you receive from the driver. Any damages to the goods must be reported directly to the driver and documented with the freight company.

It is important that you, as a customer, are available during the agreed time. If there is a missed delivery attempt, you as a customer will be charged the shipping cost for the failed delivery.


If the package is not collected as expected, Home of ESS reserves the right to charge the customer a fee equivalent to the return shipping, handling fee, and actual handling costs. If you are unable to receive a delivery or pick up your item, please contact us as soon as possible.


If you order items with different delivery times at the same time, they will be delivered in separate shipments.


Right of Withdrawal, Open Purchase, and Exchange

You have a 14-day right of withdrawal under applicable legislation. The right of withdrawal applies for 14 days from the day you received your item or receive the last item in an order where the items are delivered on separate occasions. Please note that the item must be in new condition and in its original packaging. If there was product packaging upon delivery, it must be in new condition when the return is made.


If you wish to exercise your right of withdrawal, you must notify us clearly within 14 days. If the deadline falls on a Saturday, Sunday, or public holiday, it is extended to the next business day. You then have 14 days to return your order. To most easily exercise your right of withdrawal, follow the return instructions found in your delivery. If you do not have a return label/return slip, please contact customer service.


With a few exceptions*, you have the right to open the packaging and try/examine the item you have purchased, but only to the extent necessary to determine the item's characteristics and functionality. Save the original packaging until you are sure you want to keep the item.


*Exceptions to the right of withdrawal:
  • - The right of withdrawal does not apply; mattress toppers, duvets, pillows, scent and spa items if the original packaging has been opened, as they are classified as hygiene items.

  • - The right of withdrawal does not apply to custom-made products, i.e., items manufactured according to the customer's unique preferences.

  • - Full refund of the item's value upon return within 14 days if the item is unpacked and returned in its original packaging.

  • - 75% refund of the item's value upon return within 14 days if the original packaging is broken and the item is unpacked. Returns are accepted only if the item is unused, with no damages or stains on the product.

Return Shipping for Smaller Shipments/Items
Return your unused item with all tags intact in the original packaging; if the packaging is unusable, you can use other equivalent packaging. Make sure to package it well to protect the item during transport. It is your responsibility to ensure that the item survives the return transport and that any original packaging is in new condition without damage when it arrives at our warehouse. Keep your return receipt until you receive confirmation from us that your return has been processed, as it is your proof of return.

Return Shipping for Larger Shipments/Items
Return your unused product in its original packaging. It is your responsibility to ensure that the item and original packaging are in new condition without damage when it arrives at our warehouse. If the item was delivered on a pallet, keep the pallet for any returns. We are happy to assist with booking the return. Contact us to book a pickup.

Return Cost & Refund
We offer free returns for smaller packages sent via postal outlets/service points.

For returns of larger shipments requiring pickup, such as beds and furniture, a shipping cost of 1500 SEK will be added.

Refunds are made as soon as possible and no later than within 14 days from the date we received your returned item. If your handling of the item has resulted in a depreciation of the item or if the original box is missing or damaged, a deduction for depreciation may be made; the deduction is assessed on a case-by-case basis. Refunds are made via the same payment method you used when placing the order. Refunds via bank card may take a few extra days before you see the money in your account due to the bank's processing time.


By returning the item within the deadline, you do not need to inform us of your intention to exercise your right of withdrawal in any other way, unless you wish to do so. In contact with us, be clear that you wish to exercise your right of withdrawal, and we recommend that you include the order number and other relevant information in the message to avoid errors and delays. If you contact us via email, you will receive confirmation that your email has been received shortly thereafter. Please note that refraining from picking up your delivery without clearly notifying us does not constitute exercising the right of withdrawal. Your delivery will automatically be returned to us after the specified time, but you will be charged an uncollected item fee of 150 SEK.


If you return your entire order, we will refund the entire item value, but not additional fees such as shipping costs or in-home delivery. If you choose to return only part of your order, we will not refund any shipping costs or additional fees because the fees are independent of the number of items you have ordered.


Complaints

If you encounter a problem with a product, contact us at helpme@homeofess.com. You have the right to complain about a product within three years under the Consumer Sales Act. Always keep your order confirmation. The complaint must be made within a reasonable time after you noticed or should have noticed the defect.


We have selected carriers that should provide good quality delivery. Despite this, transportation damage may occur. Be sure to check the items for any damage when you receive the delivery. For visible, external transportation damage to be eligible for complaint to the transport company, the damages must be noted on the freight company's shipping document in connection with the receipt. If you discover hidden defects/transportation damage after opening the packaging, contact our customer service.


Compensation for complaints is assessed on a case-by-case basis.


Processing of Personal Data

When you purchase goods from Home of ESS, you accept our privacy policy and our processing of your personal data. We value your personal privacy and do not collect more information than necessary to process your order. The information (such as name, address, phone number, email, IP address, purchase history) will be used to fulfill our commitments to you and provide you with good service. We use the information only for contract fulfillment and within the company's data systems and are handled in accordance with Swedish Personal Data Act (PUL).


When making a purchase, the information is shared with our payment provider Klarna. When paying by invoice, personal identification number is also saved by the payment provider. When delivering your orders and completing the purchase agreement, we need to provide specific information to the agreed freight company.


You have the right to request an extract of all information about you from us. You have the right to request correction of information that is incorrect or incomplete about you. You can request the data concerning you to be deleted at any time. There are few exceptions when the right to deletion applies, for example, if they must be kept to fulfill a legal obligation (such as the Accounting Act).

Cookies

According to the law on electronic communication, all visitors to a website must be informed about the use of cookies. When you visit our website, so-called "cookies" are stored on your computer. These are used, among other things, to keep track of which items you have added to your shopping cart, and if you do not have cookies enabled in your browser, you will not be able to complete a purchase. However, if you have disabled cookies, you will still be able to browse our website.

All rights, including copyright of homeofess.com, remain with Home of ESS. All use of this website or its content, including copying other than for your own personal, non-commercial use, is prohibited without written permission.


Force Majeure

Home of ESS accepts no liability for delays or errors due to prevailing circumstances (Force Majeure).


Dispute

Home of ESS strives for all customers to be satisfied. Disputes should first be resolved amicably through discussion with our customer service. If a dispute cannot be resolved, we recommend that you turn to the General Complaints Board (ARN) for an independent review. You can find more information at www.arn.se. Disputes regarding the interpretation or application of these terms shall be interpreted in accordance with Swedish law and, except as provided in the above paragraph, be settled by the general court in Sweden.
